Online Ad Policy

The following guidelines govern the posting of advertisements (“Ad” or “Ads”) from third parties (“Advertisers”) at HeartMD Institute (and, collectively “HMDI”):

  1. HMDI maintains absolute discretion as to what Ads will be accepted and shown at HMDI. All Ads are subject to approval by the HMDI Publisher, Editor-In-Chief, and/or Dr. Stephen Sinatra, all of which reserve the right to reject or cancel any Ad at any time.
  2. Advertising is separate from HMDI Site Content (editorial content inclusive of text, graphics and interactive questionnaires or quizzes), and Advertisers and sponsors have no advance knowledge of our Site Content. HMDI will not sell advertising for a specific product on the condition that it appear in the same location, and at the same time, as a specific article mentioning that product, unless clearly labeled as an exclusive sponsor. Advertisers do not influence any of our editorial decisions or advertising policies.
  3. The appearance of advertising at HMDI is neither a guarantee nor an endorsement by HMDI or Dr. Stephen Sinatra of the product, service, or company, nor of any claims made in such advertising.
  4. Ads appearing at HDMI and/or in HMDI emails will be clearly distinguishable from editorial content.
  5. HMDI’s advertising sales representatives or agents have neither control over, nor prior knowledge of, specific editorial content before it is published. Banner advertising is not sold or purchased based on editorial adjacency. Ads are delivered randomly throughout the site and constantly change; therefore, the adjacency of an Ad to editorial mention of product or category can occur inadvertently and infrequently.
  6. Advertisers have no control or influence over the results of Searches a user may conduct at HMDI. Search results are based solely on the functionality available through our Search software (e.g., keywords or natural language) and user-defined criteria (e.g., displaying most recent or most relevant items first).
  7. HMDI accepts and publishes all Ads on the warranty of the Advertiser and/or its agency that both are authorized to publish the entire contents and subject matter of the advertisement.
  8. Advertisers are solely responsible for the objectivity and accuracy of their Ads, and for compliance with all domestic and foreign laws and regulations applicable to their advertising. Ads for products (including NDA products) that are subject to the U.S. Food and Drug Administration (FDA) oversight must comply with FDA regulations regarding advertising and promotion. Advertisers must not suggest that HMDI has endorsed any product or service.
  9. In consideration of publication of an Ad, the Advertiser and/or its agency, jointly and severally, agree to indemnify and hold harmless HMDI, its officers, agents and employees against expenses (including legal fees) and losses resulting from the publication of the contents of the advertisement, including, without limitation, claims or suits for libel, violation of privacy, copyright infringement or plagiarism.
  10. HMDI shall not be liable for any failure to publish any Ad accepted by HMDI; however, HMDI shall use its reasonable efforts to place such Ad in subsequent available space.
  11. All Ads must clearly and prominently identify the advertiser by trademark or signature.
  12. No reference to HMDI or it products or services in As, promotional material, or merchandising by the Advertiser or its agency is permitted unless prior written approval is given the HMDI Publisher, Editor-In-Chief, or other authorized HMDI representative.
  13. All advertising contract position clauses are treated as requests. Since advertising inventory constantly changes, HMDI cannot guarantee fixed positioning, unless otherwise indicated as exclusive sponsorship.
  14. HMDI is not responsible for any damages, including but not limited to actual, direct, incidental or consequential damages, for errors in displaying any Ads.
  15. HMDI may change the terms set forth herein at any time, provided that no such change applies to Ads whose closing date precedes the announcement of the change.
  16. HMDI will not be bound by any condition, printed or otherwise, appearing on any insertion order or copy instructions when such conditions conflict with the conditions set forth in this policy statement.
  17. In the event of nonpayment, HMDI reserves the right to hold the Advertiser and/or its advertising agency liable for such monies as are due and payable to HMDI.
  18. Any use of HMDI and/or Dr. Stephen Sinatra trademarks or copyrighted material for links to and from the website must be approved, in advance, by HMDI Publisher, Editor-In-Chief or other authorized HMDI representative. Any such unauthorized linking is prohibited.
  19. Neither HMDI nor Dr. Stephen Sinatra endorses or supports any product or organization linked to HMDI website nor is HMDI or Dr. Sinatra responsible for the content of any website promoted in an Ad published on HMDI site or in print.
  20. Recruitment Ads: All Ads for employment must be nondiscriminatory and comply with all applicable laws and regulations. Ads that discriminate against applicants based on sex, age, race, religion, marital status, or physical handicap will not be accepted. Non-US recruitment Advertisers are required to confirm in writing that they are equal opportunity employers.
  21. Advertiser links to other websites cannot prevent a user from easily returning to HMDI’s website.
  22. HMDI does not release personally identifiable data on the users of our websites or email service to Advertisers.
  23. Online Advertisers may receive reports that show aggregated data about response to their Ads, including but not limited to the number of Ad impressions and the number of times an Ad was clicked on.
